Trademark Registration Process in India: Step-by-Step DIY Guide

A trademark is your brand's most valuable asset. It distinguishes your products or services from competitors and prevents others from copying your brand identity. In India, trademark registration is governed by the Trade Marks Act, 1999 and is administered by the Controller General of Patents, Designs and Trade Marks (IP India).

Step 1: Perform a Trademark Search (Public Search)

Before filing an application, you must perform a comprehensive search on the IP India database to check if your proposed name, logo, or slogan is already registered or similar to an existing mark. This prevents future objections under Section 11 of the Act.

Step 2: Choose the Correct Trademark Class

Trademarks are classified into 45 different classes under the Nice Classification. Classes 1 to 34 represent goods (e.g., Class 25 for apparel, Class 9 for software/electronics), and Classes 35 to 45 represent services (e.g., Class 35 for advertising/retail, Class 42 for IT services). Selecting the wrong class can invalidate your protection.

Step 3: Filing the Application (Form TM-A)

You can file your trademark application online via the official portal (ipindiaonline.gov.in). The filing fee is Rs. 4,500 for individuals, startups, and small enterprises, and Rs. 9,000 for other corporate entities. You will need:

  • The brand name or logo (JPEG format).
  • Details of the applicant (Name, Address, Nationality).
  • User Date (the date since which you have been using the mark, backed by a User Affidavit if used prior to filing).
