Article 311 provides two powerful constitutional safeguards to civil servants of the Union and the States (excluding defense personnel) to protect them from arbitrary political action.
1. First Safeguard: Article 311(1)
Article 311(1) reads: "No person... shall be dismissed or removed by an authority subordinate to that by which he was appointed."
- A dismissal by a subordinate officer is void from the beginning (ab initio), even if the inquiry was conducted properly.
- This prevents lower-ranking officials from arbitrary exercise of disciplinary power.
2. Second Safeguard: Article 311(2)
Article 311(2) outlines the mandate of Natural Justice (Audi Alteram Partem):
No civil servant shall be dismissed, removed, or reduced in rank except after an inquiry in which they have been informed of the charges against them and given a reasonable opportunity of being heard in respect of those charges.
This includes the right to cross-examine witnesses, present evidence, and dispute the charges before a disciplinary tribunal.
