Safeguards Against Arbitrary Dismissal (Article 311)

Article 311 provides two powerful constitutional safeguards to civil servants of the Union and the States (excluding defense personnel) to protect them from arbitrary political action.

1. First Safeguard: Article 311(1)

Article 311(1) reads: "No person... shall be dismissed or removed by an authority subordinate to that by which he was appointed."

  • A dismissal by a subordinate officer is void from the beginning (ab initio), even if the inquiry was conducted properly.
  • This prevents lower-ranking officials from arbitrary exercise of disciplinary power.

2. Second Safeguard: Article 311(2)

Article 311(2) outlines the mandate of Natural Justice (Audi Alteram Partem):

No civil servant shall be dismissed, removed, or reduced in rank except after an inquiry in which they have been informed of the charges against them and given a reasonable opportunity of being heard in respect of those charges.

This includes the right to cross-examine witnesses, present evidence, and dispute the charges before a disciplinary tribunal.
