Abetment, Criminal Conspiracy & Unlawful Assembly

Organized group offenses represent a severe threat to public order, necessitating early statutory intervention.

1. Criminal Conspiracy (BNS Section 61 [formerly IPC Section 120A/120B])

Criminal Conspiracy is defined as an agreement between two or more persons to commit an illegal act, or a legal act by illegal means.
Core Principle: The agreement itself is the actus reus; no overt illegal act needs to occur for conspiracy liability to attach.

2. Unlawful Assembly (BNS Section 189 [formerly IPC Section 141])

An assembly of five or more persons with a common object to execute criminal force, resist legal mandates, or commit mischief. All members are held vicariously liable for acts committed in pursuit of the common object under BNS Section 190 [formerly IPC Section 149].

3. Comparison Table: Common Intention vs. Common Object

Common Intention (BNS Section 3(5)) Common Object (BNS Section 190)
Requires a pre-arranged plan and prior meeting of minds. Requires only a shared purpose at the time of the assembly.
Requires active physical participation in the crime. Mere membership in the unlawful assembly is sufficient.
